Terms of Service
Last updated: October 18, 2026
These Terms of Service ("Terms") are an agreement between you and [Company Name, LLC] ("Waystone", "we", "us"), which operates the Waystone Offroad app and related websites and services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use Waystone
You must be at least 13 years old to use the Service. If you are under 18, you may use it only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. [Attorney: confirm minimum age.]
2. Off-roading is dangerous: assumption of risk
OFF-HIGHWAY DRIVING, OVERLANDING AND RELATED ACTIVITIES ARE INHERENTLY DANGEROUS. They can result in property damage, vehicle damage, serious bodily injury or death to you, your passengers and others. Risks include, among others: rollovers and falls; mechanical failure; steep, narrow, loose, washed-out or flooded terrain; changing weather, flash floods, wildfire, heat and cold; wildlife; getting lost or stranded; lack of cell service; and delayed or unavailable emergency help.
YOU VOLUNTARILY ASSUME ALL RISKS of these activities, whether or not you use the Service, and whether or not those risks are described in the Service. You alone are responsible for deciding whether to drive any trail, route, obstacle or line, and for the safety of yourself, your passengers, your vehicle and others.
3. Information may be inaccurate
Trail descriptions, routes, GPS tracks, waypoints, obstacle notes, difficulty ratings, photos, hazard flags, trail status, points of interest, cell-coverage reports, wildfire information and other content in the Service are provided "as is" for general information only. Much of it is submitted by other users or comes from third parties. It may be inaccurate, incomplete, outdated, or wrong, and conditions change quickly. We do not inspect trails and do not verify user content. Difficulty ratings are subjective opinions.
Do not rely on the Service as your only source of information. Always scout obstacles and conditions yourself, and use your own judgment.
4. Your responsibilities
- Obey all laws, regulations, posted signs, closures, seasonal restrictions and permit requirements.
- Confirm land status and legal access with the appropriate land manager before you go. The presence of a route in the Service does not mean it is open, legal or permitted.
- Stay on designated routes, respect private property, and practice Tread Lightly principles.
- Never operate the Service while driving. Let a passenger use it, or stop safely first.
- Carry appropriate maps, navigation, recovery equipment, supplies and a way to call for help, and tell someone your plans.
- Drive a properly equipped vehicle within your own skill level.
You agree to:
5. Not for emergencies or primary navigation
The Service is not an emergency service, a safety device, or a substitute for proper navigation equipment. GPS, maps, offline downloads, and phone signal can fail or be inaccurate. In an emergency, contact emergency services directly.
6. Accounts
You are responsible for your account and for keeping your password secure. Give accurate information and keep it current. You may delete your account at any time in the app under Me, Account, Delete account. We may suspend or end accounts that violate these Terms.
7. Your content
"Your content" means anything you submit to the Service, such as trails, tracks, recordings, waypoints, notes, reviews, photos, videos, check-ins, flags, tips and comments.
You keep ownership of your content. By submitting it, you grant Waystone a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable and sublicensable license to host, store, use, copy, modify, adapt, publish, display, distribute and create derivative works from your content, in any media, to operate, improve and promote the Service. This license continues for trail information (such as routes, tracks, descriptions and obstacle notes) after you delete it or your account, so the trail record stays useful to others; your name will be removed from it.
You confirm you have the rights to everything you submit, and that it is accurate to the best of your knowledge. You must not submit content that is unlawful, misleading, hateful, harassing, sexually explicit, infringing, or that reveals private information about others, encourages illegal or trespass travel, or endangers anyone. We may review, edit, refuse, remove or approve content at our discretion, but we have no obligation to monitor it. Points, levels, badges and leaderboards have no cash value and may change at any time.
8. Subscriptions and payments
Some features require a paid membership. Memberships are sold through the Apple App Store or Google Play and are subject to their terms. Memberships renew automatically at the then-current price unless you cancel at least 24 hours before the renewal date in your App Store or Google Play account settings. Refunds are handled by Apple or Google under their policies. We may change prices or features with notice as required by law. Free trials convert to paid memberships unless cancelled before the trial ends.
9. Third-party services and data
The Service uses third-party maps, imagery, wildfire, weather and other data and services. We are not responsible for them, and they may be inaccurate or unavailable.
10. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SAFETY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY TRAIL, ROUTE OR CONDITION IS SAFE, OPEN, LEGAL OR ACCURATELY DESCRIBED.
11. Release and limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE WAYSTONE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS AND AGENTS FROM ALL CLAIMS ARISING FROM YOUR OFF-ROAD ACTIVITIES, YOUR USE OF THE SERVICE, OR CONTENT PROVIDED BY OTHER USERS OR THIRD PARTIES, INCLUDING CLAIMS FOR PROPERTY DAMAGE, PERSONAL INJURY OR DEATH.
TO THE FULLEST EXTENT PERMITTED BY LAW, WAYSTONE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS OR PROPERTY, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $50.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.
12. Indemnity
You agree to defend, indemnify and hold harmless Waystone and its owners, officers, employees, contractors and agents from any claims, damages, losses and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your off-road activities, or your violation of these Terms or any law.
13. Changes and termination
We may change the Service or these Terms. If we make material changes, we will notify you in the app, and you may be asked to agree again. If you keep using the Service after changes take effect, you accept them. You may stop using the Service at any time. Sections 2, 3, 5, 7, 10, 11, 12 and 14 survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at support@waystoneoffroad.com and try to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to their jurisdiction. [Attorney: consider binding arbitration and a class-action waiver.]
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement between you and Waystone about the Service.
